These Terms of Use govern access to and use of evyaand.com. By accessing or using this website, you agree to be bound by these Terms. If you do not agree, please do not access or use the website. Nothing in these Terms excludes or restricts a right or liability that cannot lawfully be excluded or restricted.
1. Operator
The site is operated by Evgeny Andreichyk in Tel Aviv, Israel. References to “the operator”, “I”, “me” or “my” mean Evgeny Andreichyk. References to “you” mean any person accessing or using the site.
2. Permitted use and legal capacity
You may view the site for lawful personal, informational and non-commercial purposes, subject to these Terms. You represent that you have the legal capacity to accept these Terms. If you use the site on behalf of an organisation, you represent that you are authorised to bind that organisation.
The site is not directed to children under 16. A parent or legal guardian is responsible for a minor’s use where applicable law permits such use.
3. No offer of services
The site presents personal background, projects, interests and opinions. Unless a page expressly states otherwise, nothing on the site is an offer, promise, warranty, solicitation, employment commitment or binding proposal. Visiting the site or sending a message does not create a client, adviser, fiduciary, employment, agency, partnership or other professional relationship.
4. No professional advice or reliance
Site content is general information and personal commentary only. It is not legal, financial, investment, tax, medical, immigration, political, security, technical or other professional advice. It may not reflect all facts relevant to your situation. You are responsible for independent verification and for obtaining appropriate professional advice before acting or refraining from action.
5. Personal views and no endorsement

The site is a personal informational website. 7. Intellectual property
Unless a page, caption or credit says otherwise, the site’s original text, selection, arrangement, design, graphics, code and other original content are owned by or licensed to the operator and are protected by applicable copyright and other intellectual property laws. Third-party photographs, logos, quotations and other materials remain subject to the rights and credits of their respective owners.
You receive a limited, revocable, non-exclusive, non-transferable licence to access and display the site on your device for permitted use. No ownership right is transferred. Except where applicable law expressly permits otherwise or the relevant rights holder gives prior written permission, you may not:

- probe, scan or test vulnerabilities, introduce malware, interfere with availability, overload infrastructure or attempt unauthorised access;

- use the site in a manner that violates law, infringes rights or facilitates fraud, abuse or harmful activity.
These restrictions do not prohibit good-faith security research that is expressly authorised in writing, or conduct that applicable law gives you a non-waivable right to perform.
9. External links and third-party services
The site may link to or use services operated by third parties. Links are provided for convenience and context. The operator does not control, endorse or assume responsibility for third-party content, security, availability, products, claims, terms or privacy practices. You access third-party services at your own risk and under their terms.
10. Messages and submitted material
Do not send confidential, privileged, classified, proprietary or sensitive information through the site unless a secure method and confidentiality obligation have first been agreed in writing. An unsolicited message does not create confidentiality, exclusivity or a duty to act, preserve material, provide advice or reply.
You retain any rights you hold in a message. You grant the operator and relevant service providers a limited, non-exclusive right to receive, copy, store and process it only as reasonably necessary to deliver the message, respond, maintain security, comply with law and protect legal rights. You represent that you have the right to send the material and that it does not violate law or another person’s rights.

12. Disclaimer of warranties
To the maximum extent permitted by applicable law, the site and all content are provided “as is” and “as available”. The operator disclaims all express, implied and statutory warranties, including warranties of accuracy, completeness, title, non-infringement, merchantability, fitness for a particular purpose, compatibility, security, availability and freedom from harmful components.
The operator does not warrant that the site will meet your requirements, operate without interruption or error, or that defects will be corrected. You are responsible for your own devices, backups, security and decisions based on site content.
13. Limitation of liability
To the maximum extent permitted by applicable law, the operator will not be liable for any indirect, incidental, special, exemplary, punitive or consequential loss or damage, or for loss of profits, revenue, data, reputation, opportunity, business or anticipated savings, arising from or connected with the site, its content, its unavailability, third-party services or your reliance on it, under any theory of liability.
To the maximum extent permitted by applicable law, the operator’s total aggregate liability for all claims arising from or connected with the site or these Terms will not exceed US$100.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that applicable law does not permit to be excluded or limited. Some jurisdictions do not allow certain exclusions or limitations, so those provisions apply only to the extent lawful.
14. Indemnity
To the extent permitted by applicable law, you agree to defend, indemnify and hold the operator harmless from third-party claims, losses, liabilities, damages and reasonable legal costs caused by your unlawful use of the site, your material breach of these Terms, or content you submit that infringes another person’s rights. This obligation does not apply to the extent a claim is caused by the operator’s own unlawful conduct or where applicable law does not permit it.
15. Restriction or termination of access
The operator may block, restrict or terminate access, remove submitted material, or take reasonable protective action if misuse, a security risk, legal exposure or a breach of these Terms is suspected. This does not limit any other remedy available by law.
16. Changes to these Terms
These Terms may be revised to reflect changes to the site, risk or law. The effective date will be updated when a revision is published. Revised Terms apply from publication to future access and use. Where applicable law requires additional notice or acceptance, it will be provided.
17. Governing law and jurisdiction
These Terms and any non-contractual dispute connected with them are governed by the laws of the State of Israel, without regard to conflict-of-law principles. Subject to any mandatory jurisdiction or consumer right that cannot lawfully be waived, the competent courts of Tel Aviv-Jaffa, Israel have exclusive jurisdiction.
18. General terms
If a provision is unlawful or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Section headings are for convenience only. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement concerning use of this site and replace prior statements on that subject.
